Making Work Pay: Collective redundancy and fire and rehire

02/12/2024
ASCL response to the Department of Business and Trade consultation 'Making Work Pay: Collective redundancy and fire and rehire'.

This is an area of law that has attracted much media attention, highlighting the practices of those employers that seek to exploit the present legislative regime surrounding collective consultation and fire and rehire.

Many employers comply with their legal obligations; for them there is no risk with the proposed changes.

ASCL has experience of behaviour in the education sector whereby employers have offered inducements to staff to leave the Teacher’s Pension Scheme (TPS) and enter less favourable alternatives, or offer less pay for retaining the TPS, to the detriment of teachers.

ASCL welcomes the opportunity to engage in this consultation, working to protect employee rights.
